California city settles with slip-and-fall victim

Premises liability is often associated with slippery floors or debris on the service lanes of grocery stores or other businesses. The concept, however, covers many different types of injuries that are caused by the negligence or other actions by the manager or owner of a public space.

A slip-and-fall accident causing injury does not have to be in a business or other facility. Any space that is publicly available and managed by a person or entity may be the site of a premises liability injury, and the person or entity may be held responsible for the results.

The government of Santa Monica settled with the victim of a slip-and-fall accident who brought a suit against the city. The plaintiff claimed she tripped on an uneven sidewalk on the famed Wilshire Boulevard while leaving a doctor's appointment.

The plaintiff's attorney stated that one panel of concrete was two inches lower than the adjoining panel, enough to cause a serious fall. The site was on a city list of maintenance needs but had not yet been repaired. "Obviously, it was dangerous enough that it was earmarked for repair," the attorney said.

The fall dislocated the victim's shoulder, which caused the need for surgery. The case was mediated and the city council approved the settlement unanimously, saving time and legal fees in court.

Victims of premises liability injuries such as slips and falls may claim restitution through mediation, settlement or a jury verdict in civil court. An attorney can help examine evidence after an accident and prepare a case for a successful conclusion.
